Terms of Use

VinoScout is an Australian wine discovery and price-comparison website. We publish wine information and advertised prices from independent retailers so you can compare and click through to buy.

We are not a liquor retailer. We do not hold a liquor licence. We do not take orders, payments or delivery details for wine. We do not sell, supply or deliver liquor.

If you buy wine, you buy from a third-party retailer on that retailer’s website, under that retailer’s terms, privacy policy, shipping rules and liquor licence. That contract is with the retailer, not with us.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other law that cannot be excluded. Those protections can apply even though VinoScout is not a registered company.

If you are a consumer, the Service comes with guarantees that cannot be excluded, including that services will be provided with due care and skill, will be fit for a disclosed or agreed purpose, and will be supplied within a reasonable time where no time is set.

If a term would be unfair or unlawful under the ACL, it is not enforceable to that extent.

You must be 18 or older to use the Service. By using it you confirm that you are 18 or over and that you will not use it to help anyone under 18 obtain alcohol.

We may ask you to confirm your age, and we may suspend or end access if we reasonably believe you are under 18.

Retailers are responsible for their own age checks, licence conditions and delivery rules when you buy from them.

Alcohol should be consumed responsibly. Information on the Service is not medical advice and is not an invitation to drink. If you are pregnant, planning pregnancy, or unsure whether alcohol is appropriate for you, seek advice from a health professional.

Some features, including price tracking and alerts, need an account. You agree to keep your details accurate, keep your sign-in details confidential, not share your account, tell us if you think someone else has used it, and sign out on shared devices.

If you sign in with Google or another identity provider, their terms also apply to that sign-in.

We may refuse, suspend or close an account where we reasonably need to protect the Service, other users, or to comply with the law (for example suspected fraud, under-age use, or a serious breach of these Terms). Where practical, we will tell you.

You may close your account by emailing hello@vinoscout.au.

You may use the Service only for lawful purposes and in line with these Terms.

You must not:

• use the Service if you are under 18
• scrape or bulk-download the Service except as we expressly allow, or as Australian law permits
• try to bypass security or interfere with the Service
• impersonate another person
• use the Service to send spam or to collect other people’s personal information
• copy the catalogue or our branding in bulk without permission, except as Australian law allows
• use the Service in a way that promotes supply of alcohol to minors, or that encourages irresponsible or excessive drinking
• use the Service in a way that is unlawful or infringes someone else’s rights

Wine names, vintages, images, stock status and prices are compiled from retailers and other public sources. They can change without notice.

Prices are advertised prices at the time we last collected them. They may be wrong, incomplete or out of date by the time you click through. Delivery, discounts and pack size on the retailer’s site may change what you pay. Two listings may look like the same wine and still differ.

A displayed price is not an offer by VinoScout to sell wine. The retailer’s checkout is the contract of sale. Confirm price, vintage, format and shipping on the retailer’s site before you buy.

Tasting notes, flavour descriptions or scores, if shown, are opinions or summaries. They are not a guarantee of how a bottle will taste.

When you follow a link to a retailer, you leave VinoScout. We are not a party to your purchase and we are not the seller or delivery provider. Complaints about payment, shipping, refunds, breakage or product quality should go to the retailer.

Some links may be tracked so we can see that a click happened. That does not make us the seller.

We own the VinoScout branding, design, software and the way we organise the catalogue. Retailer names, wine brands, bottle images and product text belong to their owners. Showing them is not an endorsement unless we say so.

You may browse the Service and share a link to a page. You may not copy the catalogue in bulk, frame the site, or reuse our branding without written permission, except as Australian law allows.

If you believe material on the Service infringes your copyright, email hello@vinoscout.au with the URL and a description of the work.

Price alerts depend on how often we update prices and on retailer sites remaining available. We do not promise that an alert will fire the moment a price changes, that we will catch every change, or that an alerted price will still be available when you click through.

You can turn alerts off in the Service or by emailing us.

We aim to keep the Service available, but we do not promise uninterrupted or error-free operation. We may change, pause or discontinue features, carry out maintenance, or limit access for security or legal reasons. Where a change is material and you have an account, we will take reasonable steps to give notice, unless we need to act faster for security or legal reasons.

Your ACL rights are not limited by this section.

To the extent permitted by law:

• we are not liable for retailers’ prices, stock, products, delivery or websites
• we are not liable for loss that is not reasonably foreseeable
• we are not liable for loss caused by your breach of these Terms, or by relying on a displayed price without checking the retailer’s site
• we are not liable for failure or delay caused by events beyond our reasonable control

Where the ACL allows a limitation for services that are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again.

The Service is free at the date of these Terms. If we later offer paid plans, we will state the price up front and update these Terms.

You are responsible for your use of the Service, purchases you make with retailers, complying with liquor and other laws that apply to you, and keeping your devices and sign-in details secure.

If your use of the Service is unlawful or seriously breaches these Terms and that causes us loss, you may be asked to cover that loss. This does not apply to anything we caused by our own negligence or failure to meet a non-excludable obligation.

We may update these Terms. The “Last updated” date will change. For material changes we will take reasonable steps to notify you before they apply, except where we must change them sooner to comply with the law. If you do not agree, stop using the Service and you may close your account.

You may stop using the Service at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, if we reasonably need to protect minors, other users or the Service, or if we stop operating VinoScout. Where practical we will give notice.

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.

You agree we may communicate with you electronically about the Service.

If a term is unenforceable, the rest still applies. If we do not enforce a term on one occasion, we may still enforce it later.

These Terms and the Privacy Policy are the main terms for use of the Service.

You may not assign these Terms without our consent. We may assign them if the Service is transferred, provided your ACL rights are not reduced.

Nothing in these Terms makes us partners or agents of you or of any retailer.
